PLEASE READ CAREFULLY. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS.
This agreement includes a release of liability and a waiver of certain legal claims, including claims based on the ordinary negligence of DirtDaisy LLC and others. By accepting it, you are giving up the right to sue for certain injuries, including serious injury and death.
Do not accept this agreement unless you have read it, understand it, and agree to be bound by it.
This is a separate agreement. It is not part of the DirtDaisy Collective Terms of Service, and accepting the Terms of Service does not accept this waiver. You must accept this waiver separately before participating in any ride organized or found through the DirtDaisy Collective. We record your acceptance, its date and time, and the version of this document you accepted.
Who signs this document: This version is for participants who are 18 or older. A member who is 16 or 17 does not accept this document; a parent or legal guardian accepts the teen version on their behalf. If you are under 18, stop here.
1. What I am agreeing to participate in
I am choosing to take part in mountain biking and related activities connected to the DirtDaisy Collective ("the Activity"). This includes riding to, on, and from trails; meeting at trailheads and parking areas; gathering before and after a ride; and any related travel, social, or trail activity connected to a ride I found or arranged through the Collective.
I understand that the Activity may take place anywhere in the United States, on public or private land, in developed trail systems or in remote areas, and that conditions, rules, and available emergency services differ substantially from place to place.
2. I understand what DirtDaisy is --- and what it is not
I understand and agree that:
- DirtDaisy Collective is a community connection platform. It helps members find one another, post rides, and share information. It is not a guiding service, a tour operator, a cycling club, a coaching business, or an event promoter.
- DirtDaisy does not organize, lead, supervise, staff, inspect, or approve rides. A ride I find through the Collective is a gathering of individual people who each decided to show up.
- Ride Hosts are volunteer community members. They are not employees or agents of DirtDaisy, and they are not professional guides, coaches, medical providers, first responders, mechanics, equipment inspectors, trail inspectors, childcare providers, or chaperones. A Ride Host is not responsible for me, does not take custody of me, and does not guarantee my safety.
- DirtDaisy does not conduct background checks on members, Ride Hosts, or anyone else present at a ride, and has not screened anyone I may meet.
- DirtDaisy does not inspect trails, verify trail conditions, or confirm that information posted by members is accurate. Ride descriptions, difficulty ratings, pace descriptions, distances, and trail notes are written by members and are opinions, not professional assessments.
- DirtDaisy does not monitor rides, track participants, or provide emergency response. No one is watching to see whether I return.
- DirtDaisy does not provide dedicated fields for health, medical, disability, or accessibility information and does not intentionally request that information for ordinary ride participation. Such information could reach DirtDaisy incidentally through an incident report or other member-submitted communication. DirtDaisy does not provide participant health information to Ride Hosts.
I am not relying on DirtDaisy, any Ride Host, or any other participant to evaluate my abilities, my equipment, the trail, the weather, or whether I should ride.
3. I understand the risks
Mountain biking is inherently dangerous. People are seriously injured and killed doing it.
I understand that the Activity involves risks that cannot be eliminated, including:
- falling, crashing, and colliding with the ground, trees, rocks, roots, terrain features, structures, other riders, other trail users, animals, or vehicles
- loss of control at speed, on descents, on jumps and drops, on bridges and skinnies, and on loose, wet, icy, sandy, or uneven surfaces
- mechanical failure of any part of my bicycle, helmet, or equipment, whether or not I maintained it
- trail hazards, including ones that are hidden, unmarked, newly created, changed, poorly maintained, or that I simply do not see
- weather, lightning, heat, cold, hypothermia, heat illness, dehydration, sun exposure, smoke, and rapidly changing conditions
- remote terrain, difficult evacuation, no cell service, delayed rescue, and delayed medical care
- wildlife, insects, and plants
- the conduct of other participants, other trail users, motorists, or third parties --- including conduct that is careless, reckless, or unlawful
- my own physical condition, fitness, fatigue, judgment, inexperience, medical condition, or medication
- becoming separated from a group, being left behind, or riding alone
- injuries including broken bones, concussion and other brain injury, spinal injury, paralysis, internal injury, disfigurement, permanent disability, and death
I know this list is not complete. There are risks I have not thought of and risks no one can predict. I accept those too.
I VOLUNTARILY ASSUME ALL RISKS OF THE ACTIVITY, both those described above and those that are unknown, whether they arise from the inherent nature of mountain biking, from conditions, from the conduct of others, or from the ordinary negligence of the people and organization released below.
4. My own responsibilities
I confirm that:
- I am 18 or older and legally able to enter into this agreement.
- I decide whether to ride. For every ride, every trail, and every feature, I alone decide whether it is appropriate for me on that day.
- I am responsible for evaluating my own experience, fitness, health, and ability, and for knowing my limits.
- I am medically able to participate, or I have accepted the risk of participating anyway. DirtDaisy has not asked about my health and does not know my medical history.
- I will use a bicycle and equipment in safe working condition, and I am responsible for inspecting and maintaining them. No one else will inspect them for me.
- I will wear a properly fitted bicycle helmet at all times while riding.
- I will carry what I reasonably need, including water, food, tools, and any personal medication.
- I will obey trail signs, closures, land-manager rules, and all applicable laws wherever I ride.
- I will not participate while impaired by alcohol, cannabis, drugs, medication, fatigue, or illness.
- I am responsible for my own transportation, and for my own emergency and evacuation plan.
- I will stop, slow down, turn around, or leave whenever I choose, and I will not let anyone pressure me into riding beyond my ability.
- I am responsible for my own costs, including medical care, ambulance, evacuation, rescue, and transportation.
5. If I bring my child under 16
This section applies only if I bring my own child who is under 16 to a ride.
It does not apply to a member who is 16 or 17. A 16- or 17-year-old participates only as a Collective member, through the teen-member process, and their parent or legal guardian accepts the separate Teen Activity Waiver on their behalf. I may not bring a 16- or 17-year-old to a ride under this section.
I understand that DirtDaisy does not register children, does not request a child's name, age, or other registration information, and does not create a child registration record. A child I bring is my responsibility alone and is not a member or participant of the Collective. I understand that information about my child could still reach DirtDaisy incidentally --- for example in an incident report or a photograph another member posts.
If I bring my child under 16, I confirm and agree that:
- I am that child's parent or legal guardian. I will not bring another person's child, and I have no authority to accept this agreement on behalf of a child who is not mine.
- I am participating in the ride myself and will remain with my child throughout. I will not drop my child off, leave my child with a Ride Host or another rider, or ask anyone else to supervise my child. If I stop, fall behind, ride ahead, or leave, my child comes with me.
- I alone decide whether the ride is appropriate for my child --- the pace, the distance, the terrain, the technical features, the weather, and my child's abilities, health, bicycle, helmet, and equipment. A "family-friendly" label on a ride listing is the posting member's own description of what they planned. It is not a DirtDaisy assessment and not a statement that any ride suits any particular child.
- My child will wear a properly fitted bicycle helmet at all times while riding and will follow ride rules and trail rules.
- No Ride Host, member, or other participant takes responsibility for my child at any point. No one is watching my child but me.
Assumption of risk when I bring my child. I have read Section 3 and I understand those risks apply to my child as well, and that children may face some of them more severely. On my own behalf, I voluntarily assume all risks of my child's participation. I understand a child cannot legally assume these risks or accept this agreement, and that I am the one making this decision and accepting these risks.
What I am releasing. On my own behalf, I release the Released Parties from all claims I may have arising from my child's participation, including claims for my own emotional distress, my child's medical or funeral expenses, loss of my child's services or companionship, and any other claim that belongs to me as a parent or guardian, whether it arises directly or derives from an injury to my child.
What I am not releasing. I understand that this agreement does not, and does not attempt to, release my child's own independent legal claims where the law does not permit a parent to do so. Nothing in this section limits a right that cannot lawfully be waived on a child's behalf.
Indemnification. To the fullest extent permitted by law, I agree to indemnify and hold the Released Parties harmless from any claim brought by or on behalf of my child, or by anyone claiming through my child, arising from my child's presence or participation --- except to the extent the claim arises from conduct for which indemnification cannot lawfully be required. This obligation is mine alone. My child owes nothing under this agreement and is not bound by it.
6. Release of liability
Released Parties means DirtDaisy LLC and its owners, officers, members, managers, employees, contractors, and representatives. A member does not become a Released Party merely by posting, hosting, or participating in a ride.
To the fullest extent permitted by law, I release, waive, discharge, and agree not to sue the Released Parties from and for any and all claims, demands, causes of action, liabilities, damages, losses, costs, and expenses of any kind --- including personal injury, disability, death, and property damage --- arising out of or related to my participation in the Activity, including claims caused in whole or in part by the ordinary negligence of a Released Party.
This release applies whether the claim arises from the inherent risks of mountain biking, from conditions at any location, from the acts or omissions of another participant, from equipment, or from the ordinary negligence of a Released Party.
This release does not apply to, and I do not waive, any claim arising from:
- gross negligence, recklessness, or willful, wanton, or intentional misconduct
- conduct for which liability cannot lawfully be released or limited under applicable law
- any other right that cannot lawfully be waived
Ride Hosts and other participants. I understand that a Ride Host is a volunteer community member and not a Released Party as an agent of DirtDaisy. My decision to ride with any person is my own. Nothing here prevents me from pursuing a claim against another individual for their own conduct.
7. Indemnification
To the fullest extent permitted by law, I agree to indemnify, defend, and hold the Released Parties harmless from any claim, liability, damage, loss, cost, or expense --- including reasonable attorney fees --- brought by me or by anyone claiming through me, or arising from:
- my own conduct during the Activity
- my violation of the Terms of Service or Community Guidelines
- injury or damage I cause to another person or their property
- the presence or participation of my child under 16 whom I bring, as described in Section 5
This does not apply to the extent a claim arises from conduct for which indemnification cannot lawfully be required, and does not require any child or minor to indemnify anyone.
8. Emergency care
If I am injured or become ill, I authorize any Released Party, Ride Host, participant, bystander, or emergency responder to summon emergency assistance and to arrange emergency medical care, evacuation, or transportation for me if they reasonably believe it is necessary.
What this does and does not mean. Nothing in this document requires any person to place themselves or others in danger. If an emergency occurs, people present may contact emergency services, provide reasonably available information, and assist with arranging emergency evaluation, evacuation, or transportation. Any obligation to provide reasonable assistance is governed by applicable law.
DirtDaisy, Ride Hosts, and participants do not guarantee that emergency assistance, evacuation, transportation, cellular service, or professional medical care will be available or timely. DirtDaisy does not monitor rides, track participants, or operate a rescue or emergency-response service, and I am not relying on it to do so. This provision does not waive or eliminate any duty imposed by applicable law.
I am responsible for the cost of any medical care, ambulance, evacuation, rescue, or transportation provided to me or to my child under 16 whom I bring, to the extent permitted by law. I understand DirtDaisy does not provide accident, health, disability, or life insurance for participants, and that I am responsible for my own insurance coverage.
9. Where this agreement applies and which law governs
I understand that rides connected to the Collective take place in multiple states, and that the law governing waivers differs from state to state.
Except where applicable law requires otherwise, this agreement is governed by the laws of the State of Minnesota, without regard to conflict-of-law principles, and any court proceeding arising from it must be brought in a state or federal court with jurisdiction in Hennepin County, Minnesota. I consent to personal jurisdiction and venue there.
State-specific terms. If I participate in a ride in a state for which DirtDaisy has issued a state-specific addendum to this agreement, that addendum applies to that ride and controls over any conflicting term here. Where the law of the state in which an injury occurs governs the enforceability of this agreement, that law applies to that question.
This agreement does not require arbitration and does not waive my right to a jury trial. It does not prevent me from reporting a safety concern or suspected crime, making a complaint to a government agency, or bringing an eligible claim in small-claims court.
10. Severability and interpretation
I intend this agreement to be interpreted as broadly as the law allows.
If any part of it is found unenforceable --- including in a state whose law limits or prohibits pre-injury releases --- the rest of the agreement remains in full effect, and the unenforceable part will be enforced to the maximum extent permitted. If a release of liability is unenforceable in a particular state, my assumption of risk in Sections 3 and 5 remains effective to the fullest extent the law allows.
No Released Party's failure to enforce a term waives the right to enforce it later. This agreement binds my heirs, next of kin, executors, administrators, personal representatives, and assigns.
11. My acknowledgment
By accepting this agreement, I confirm that:
- I have read it in full and understand it.
- I understand I am giving up substantial legal rights, including the right to sue for injuries caused by ordinary negligence.
- I am accepting it freely and voluntarily. No one pressured or rushed me.
- I have had the opportunity to ask questions and to have a lawyer review it.
- No Released Party has made any promise or representation to me about safety that is not written in this document.
- I am 18 or older and legally able to accept it.
- If I bring my child under 16, I have read and accepted Section 5 and I am that child's parent or legal guardian.
I understand that this agreement remains in effect for every ride I participate in until I withdraw it or DirtDaisy issues a new version, and that I may be asked to confirm it still applies when I join a particular ride.
