Welcome to the Collective

DirtDaisy Collective is a community platform created to help riders find one another, share trail knowledge, and organize opportunities to ride together. The Collective is operated by DirtDaisy LLC ("DirtDaisy," "we," "us," or "our").

DirtDaisy Collective centers women and girls in mountain biking and welcomes people who genuinely support that mission and follow our community standards.

These Terms of Service ("Terms") govern your access to and use of the DirtDaisy Collective website, app, community features, and related services (collectively, the "Collective"). They also explain the basic rules that apply when members use the Collective to connect for an in-person ride.

Please read these Terms carefully. By creating an account, accessing or using the Collective, or clicking to accept these Terms, you agree to be bound by them. If you are accepting these Terms as the parent or legal guardian of a member who is 16 or 17 years old, "you" includes both you and that teen member where the context permits.

If you do not agree to these Terms, do not create an account or use the Collective.

1. Important distinction: the platform and mountain biking

The Collective is a community connection platform. It helps members discover trails, share information, create or find rides, and connect with other riders.

DirtDaisy does not operate a professional guiding, coaching, transportation, medical, childcare, trail-maintenance, or equipment-inspection service. A ride posted through the Collective is a gathering of individual community members who each choose whether and how to participate.

Where the Collective operates

The DirtDaisy Collective may help members connect for rides and community activities throughout the United States. Members and Ride Hosts are responsible for complying with the laws, trail rules, land-manager requirements, and other regulations applicable where an activity occurs. Availability of the Collective or a ride listing in a location does not mean DirtDaisy has inspected, approved, or assumed responsibility for that location or activity.

The risks of the activity

Mountain biking and related outdoor activities involve inherent and other risks, including falls, collisions, equipment failure, changing trail and weather conditions, remote locations, limited cell service, encounters with other trail users or wildlife, serious bodily injury, permanent disability, and death.

Before participating in a ride, you must separately accept the current Mountain Biking Assumption of Risk & Liability Waiver that applies to you. The waiver is a separate agreement with its own acceptance record and version, accepted separately from these Terms. Because the Collective operates in more than one state, the waiver may include state-specific provisions or addenda, and the waiver applicable to a particular ride or location may differ. These Terms do not replace, restate, or substitute for the waiver.

When you join an individual ride, you may also be asked to complete a short ride-specific acknowledgment or to confirm that your waiver remains in effect.

2. Who may use the Collective

Adults

You may create and manage your own account if you are at least 18 years old and legally able to enter into an agreement.

Members ages 16--17

The minimum age for an individual Collective account is 16.

A person who is 16 or 17 years old may create an account only through DirtDaisy's guardian-approval process. Before the teen account may be used to join rides, a parent or legal guardian must:

provide their name, contact information, and stated relationship to the teen;
review and accept these Terms on the teen's behalf;
review and sign the applicable Mountain Biking Assumption of Risk & Liability Waiver on the teen's behalf;
provide any required emergency-contact information; and
agree to the additional privacy and safety rules applicable to teen accounts.

The teen member must also agree to follow these Terms, the Community Guidelines, and ride-safety requirements, and must acknowledge the risks of the activity. Guardian approval does not guarantee that every ride will be open to teen members.

Our guardian-approval process records a guardian's stated identity and stated relationship to the teen. It is a consent record. It does not conclusively verify that a person is who they say they are or that they hold legal guardianship.

DirtDaisy may contact the approving guardian about the teen's account, safety, participation, reports, or suspected violations. A guardian may ask us to close the teen's account by contacting crystal@dirtdaisy.com.

Children under 16

Children under 16 may not create Collective accounts and may not use the Collective.

A child may be brought to a ride by their own parent or legal guardian, who remains fully responsible for them, as described in Section 8. A child brought to a ride is not a member or participant of the Collective, does not register with DirtDaisy, and provides no information to us.

Ride Hosts

Ride Hosts must be at least 18 years old. DirtDaisy may establish additional eligibility, training, verification, or account-standing requirements for Ride Hosts.

3. Your account

You agree to provide accurate, current information and to keep it updated. You are responsible for:

safeguarding your password and account access;
activity conducted through your account;
promptly notifying us if you suspect unauthorized use; and
using only your own account.

Do not impersonate another person, create an account for someone else without authorization, misstate your age or guardian relationship, or allow another person to use your account to bypass eligibility or safety requirements.

Usernames, profile information, and other account content must follow the Community Guidelines. We may require a username or profile field to be changed if it creates a safety, privacy, impersonation, or community-conduct concern.

4. Founding Riders and community roles

"Founding Rider" is a community honor recognizing an early member who helped build the Collective. It is not an ownership interest, employment position, legal partnership, promise of compensation, or guarantee of permanent access or benefits.

Other labels or roles --- such as Ride Host, Trail Steward, Builder, or community badges --- describe participation within the Collective. Unless DirtDaisy expressly agrees otherwise in writing, these roles do not create an employment, agency, franchise, fiduciary, joint-venture, or partnership relationship with DirtDaisy.

5. The Collective is currently free

Membership, platform features, and community rides offered through the Collective are currently free unless a ride listing clearly states otherwise.

We may add optional paid products, events, subscriptions, or features in the future. If we do, we will disclose the price and any additional terms before you make a purchase. We will not charge you merely because these Terms change.

Individual members remain responsible for their own costs, including equipment, transportation, trail passes, parking, food, lodging, medical care, and any third-party fees.

Ride Hosts may not charge participation fees, collect required donations, sell access, or present a ride as a paid DirtDaisy event unless DirtDaisy has expressly approved it in writing.

6. Community rules

DirtDaisy Collective centers women and girls in mountain biking and welcomes people who genuinely support that mission and follow our community standards. We do not ask members to prove or document their gender.

You agree to follow:

these Terms;
the Community Guidelines;
the rules stated in a ride listing;
lawful instructions from trail owners, land managers, park staff, and emergency personnel; and
applicable laws, trail closures, permits, and access rules where the activity occurs.

You may not use the Collective to:

harass, threaten, stalk, exploit, discriminate against, or endanger another person;
share another person's private information without permission;
engage in unlawful, fraudulent, deceptive, or harmful activity;
sexualize, groom, exploit, or otherwise behave inappropriately toward a minor;
arrange an unauthorized drop-off or childcare situation;
post dangerous misinformation or intentionally conceal a known safety issue;
interfere with the Collective's operation or security;
scrape, harvest, or misuse member data;
send spam or unauthorized commercial promotions;
upload malware or attempt to gain unauthorized access; or
evade a suspension, restriction, safety control, or account ban.

The Community Guidelines provide more detail and are incorporated into these Terms by reference.

7. Ride Hosts are community coordinators

A Ride Host is an adult community member who volunteers to suggest a meeting place and time and help riders connect. Ride Hosts are not DirtDaisy employees or agents, professional guides or coaches, medical providers, childcare providers, transportation providers, or trail inspectors. They are not guarantors of safety, trail conditions, weather, participant ability, or equipment condition.

Ride Hosts do not collect, receive, or act on participant health, medical, disability, or accessibility information. DirtDaisy does not provide that information to a Ride Host, and a Ride Host may not request or retain it. A Ride Host is not responsible for knowing, accommodating, or responding to a participant's medical condition.

A Ride Host does not take custody of, or assume responsibility for, any participant or any minor brought to a ride, and is not responsible for:

determining whether a participant has the skill, fitness, health, equipment, or judgment needed for a ride;
inspecting, repairing, or certifying a participant's bicycle or equipment;
guaranteeing the accuracy of trail information or the condition, legality, or availability of a trail;
supervising any participant, individually or as a group;
providing first aid, rescue, transportation, or emergency services;
guaranteeing that a group will remain together in every circumstance; or
protecting participants from the inherent or other risks of mountain biking.

Ride Hosts must provide ride information honestly and make reasonable efforts to identify the planned location, difficulty, pace, distance, and special expectations. They must not claim professional qualifications they do not have or promise that a ride is risk-free.

DirtDaisy may approve, decline, restrict, suspend, or remove Ride Host privileges at any time. Any host orientation, suggested ride plan, safety checklist, badge, or platform approval is a community safeguard; it is not professional certification or a guarantee that a Host or ride is safe.

8. Family-friendly rides and bringing a minor

A member may mark a ride they post as family-friendly, meaning they have planned a pace and terrain they consider suitable for adults riding with their own children. This is the posting member's own description. It is not a DirtDaisy assessment, review, or approval, and it is not a guarantee that a ride is suitable for any particular child.

Children do not register with DirtDaisy, do not have accounts, and are not members or participants of the Collective. We do not request a child's name, age, or any other registration information, and we do not create a child registration record. Information about a child may still reach us incidentally --- for example in an incident report or a photograph another member posts. The Privacy Policy describes how we handle that.

If you bring a minor to a ride:

You must be the minor's parent or legal guardian, and you must be participating in the ride yourself.
You are solely responsible for the minor at all times --- before, during, and after the ride.
You decide whether the minor's abilities, health, bicycle, helmet, other equipment, and the current conditions are appropriate for the ride. No one else can make that decision and no one else is making it for you.
The minor must wear a properly fitted bicycle helmet at all times while riding and must follow ride rules and trail rules.
You remain responsible for the minor even if you fall behind, ride ahead, stop riding, or leave. No Ride Host or other member assumes responsibility for a minor at any point.
You are responsible for the minor's conduct, and the minor must follow these Terms and the Community Guidelines while present.

Drop-offs are not permitted. You may not bring another person's child. You may not ask a Ride Host or another member to supervise a minor.

A minor cannot agree to these Terms or accept the assumption of risk described in the separate waiver. By bringing a minor to a ride, you accept, on your own behalf, the risks of that minor's participation and the responsibility for supervising them. Your own Mountain Biking Assumption of Risk & Liability Waiver applies to your decision to bring a minor.

DirtDaisy does not organize, supervise, staff, or approve rides that include children, and does not provide childcare, supervision, guiding, coaching, medical care, or equipment inspection for anyone.

9. Your responsibilities when choosing and joining a ride

You decide whether a ride is appropriate for you and for any minor in your care. Ride labels, member profiles, skill levels, pace descriptions, Ride Vibes, Trail Guides, and comments are subjective community information created by members. They are not professional evaluations or safety guarantees.

Before and during a ride, you are responsible for:

honestly evaluating your experience, fitness, health, comfort, and ability;
reviewing the planned trail, distance, difficulty, pace, weather, and available exit points;
using a properly maintained bicycle and appropriate equipment;
wearing a properly fitted bicycle helmet at all times while riding;
carrying supplies reasonably appropriate for the ride;
obeying trail signs, closures, land-manager rules, and applicable law where the ride occurs;
riding under control and yielding as required;
communicating if you need to slow down, stop, leave, or seek help;
making your own decision to continue, change course, or end your participation; and
arranging your own transportation and emergency plan.

A ride listing shows where a group of people plans to be at a specific time, and depending on the feature and settings may be visible to other members or publicly. Do not use a private residence as a meeting location, and consider what a listing reveals about your own routine before posting it.

Do not participate while impaired by alcohol, cannabis, illegal drugs, medication, fatigue, illness, or any condition that makes riding unsafe.

Joining a ride does not reserve professional supervision, guarantee attendance, guarantee a particular route or experience, or obligate any participant to continue. Conditions may change, rides may be modified or cancelled, and members may leave at any time.

If you have a medical condition or question about your ability or a minor's ability to participate, consult an appropriate healthcare professional. DirtDaisy and Ride Hosts do not provide medical advice.

10. Emergencies and incident reporting

In an emergency, call 911 or the appropriate local emergency service when possible. Do not rely on the Collective, DirtDaisy, or a Ride Host to monitor a ride or summon assistance.

The Collective may allow members to provide emergency-contact or limited safety information. Providing that information does not create a monitoring, rescue, medical-care, or notification obligation on the part of DirtDaisy.

Nothing in this section waives or eliminates any duty imposed by applicable law, including any duty of a person present at an emergency scene to provide reasonable assistance. Nothing in these Terms requires any person to place themselves or others in danger.

You agree that a Ride Host, member, DirtDaisy, or emergency responder may seek emergency assistance when they reasonably believe it is necessary. You remain responsible for costs associated with your medical care, evacuation, rescue, transportation, or other services to the extent allowed by law.

Safety concerns and significant incidents connected to a Collective ride should be reported to safety@dirtdaisy.com as soon as reasonably possible. Reporting allows us to review community access and safety practices, but it does not make DirtDaisy an investigator, insurer, or law-enforcement agency.

11. Ride listings, Trail Guides, and third-party information

Ride listings, Trail Guides, trail status, maps, weather, difficulty ratings, parking details, facilities, cell coverage, and other outdoor information may be created by members, obtained from third parties, or become outdated quickly.

DirtDaisy does not guarantee that this information is complete, current, or accurate. Trail conditions, access, closures, construction, weather, rules, hazards, and services can change without notice, and requirements differ from state to state and from one land manager to another. Always check official land-manager sources and current conditions before traveling or riding.

The Collective may link to outside resources such as land-manager websites, trail information services including TrailBot and Trailforks, map providers, weather services, or other third-party resources. At launch these are provided as outbound links rather than Collective account integrations. DirtDaisy does not control or endorse every third-party resource and is not responsible for its availability, accuracy, privacy practices, terms, products, or services. Your use of a third-party service is governed by that service's own terms. The Privacy Policy describes what information may pass between your browser and a linked service.

12. Content you share

"Member Content" means photos, videos, Ride Memories, ride listings, comments, trail notes, profile information, messages, reports, and other material that you submit to the Collective.

You retain ownership of your Member Content. You are responsible for it and promise that:

you created it or have the rights and permissions needed to share it;
it does not violate another person's privacy, publicity, copyright, trademark, or other rights;
it is accurate where you present it as factual or safety-related information; and
it follows these Terms and the Community Guidelines.

Platform-use license

When you submit Member Content, you give DirtDaisy a nonexclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, format, adapt for technical display, and show that content as reasonably necessary to operate, secure, moderate, improve, and provide the Collective. The sublicense right exists only so that we can use ordinary service providers such as hosting, storage, content-delivery, and moderation vendors. It does not permit promotional use.

This license does not transfer ownership to DirtDaisy. It ends when your content is deleted from the Collective, except:

copies may remain for a reasonable period in backups, security records, legal records, or previously generated system logs;
content shared with others may remain where another member independently reposted or retained it lawfully; and
DirtDaisy may retain content when reasonably necessary to investigate safety concerns, enforce these Terms, comply with law, or establish or defend legal claims.

Promotional use is separate and voluntary

The platform-use license above does not give DirtDaisy permission to use your image, likeness, name, or story in advertising, merchandise, promotional campaigns, or other marketing.

Any promotional use is governed by the separate Community Media License, which is voluntary. Accepting the Community Media License is not a condition of creating an account, maintaining membership, joining a ride, bringing a minor to a ride, or participating in any part of the Collective. You may decline it, or withdraw it as described in that document, and continue to participate fully.

Feedback

If you voluntarily send DirtDaisy ideas or feedback about the Collective, you allow us to use that feedback without payment or obligation to you. This does not give us ownership of your separate creative work or Member Content.

13. How we moderate the Collective

DirtDaisy may --- but is not required to --- review, restrict, remove, preserve, or disclose Member Content or account information when we reasonably believe it is necessary to:

operate or secure the Collective;
enforce these Terms or the Community Guidelines;
respond to reports or safety concerns;
protect members, minors, DirtDaisy, or the public;
prevent fraud, abuse, or unlawful activity; or
comply with law, legal process, or a valid government request.

Moderation decisions require judgment. We do not guarantee that we will identify every violation or harmful interaction, and we are not responsible for pre-screening any member, Ride Host, ride, message, or item of content.

We may use warnings, content removal, feature restrictions, Ride Host removal, temporary suspension, or permanent account termination. Serious safety concerns --- especially those involving minors, violence, credible threats, stalking, sexual misconduct, or attempts to evade restrictions --- may result in immediate action.

14. Member interactions and background checks

Use the same care meeting a Collective member that you would use meeting any person first encountered online.

DirtDaisy does not conduct background checks. We do not perform criminal, identity, driving-record, professional-license, or sex-offender checks on members, Ride Hosts, or anyone a member brings to a ride. No person on the Collective has been screened by us.

If we introduce a verification or screening feature in the future, we will say so clearly. Any such feature would be limited to the information and time reviewed and would not guarantee a person's identity, character, qualifications, conduct, or future behavior.

DirtDaisy is not responsible for privately arranged transportation, lodging, purchases, equipment loans, childcare, coaching, or other agreements between members. Those arrangements are outside the Collective unless we expressly say otherwise.

15. Privacy

Our Privacy Policy explains how DirtDaisy collects, uses, shares, and retains personal information, including the information collected to record guardian approval for a teen account. By using the Collective, you acknowledge that you have reviewed it.

Do not post sensitive personal information in public profile fields, ride comments, Ride Memories, Trail Guides, or other community areas. Teen accounts may have more protective default settings and feature limits.

16. Ownership of the Collective

Except for Member Content and third-party materials, the Collective --- including its software, design, branding, logos, text, graphics, curated materials, and other content --- is owned by or licensed to DirtDaisy and is protected by intellectual-property laws.

Subject to these Terms, DirtDaisy gives you a limited, personal, nonexclusive, nontransferable, revocable right to access and use the Collective for its intended community purpose.

You may not copy, sell, license, reverse engineer, distribute, modify, create derivative commercial services from, or exploit the Collective or DirtDaisy materials except as allowed by law or with our written permission. You may share ordinary links and use built-in sharing features in accordance with these Terms.

"DirtDaisy," "DirtDaisy Collective," related logos, and other brand identifiers may not be used in a way that implies sponsorship, endorsement, or an official DirtDaisy event without written permission.

17. Copyright reports

DirtDaisy responds to notices of claimed copyright infringement. Notices should include identification of the copyrighted work, identification of the material claimed to be infringing and where it is located on the Collective, your contact information, and the statements required by applicable law.

We may remove or disable access to material in response to a valid notice and may terminate the accounts of repeat infringers. Further detail appears in the Copyright & Content Reporting Policy.

18. Changes, interruptions, and ending features

The Collective is a growing community, and features may change. We may add, modify, restrict, pause, or discontinue any part of the Collective. We do not promise that every feature, ride listing, item of content, badge, or benefit will always remain available.

We may perform maintenance or experience outages, data loss, security events, or third-party service interruptions. We work to operate the Collective responsibly, but uninterrupted, secure, accurate, or error-free access is not guaranteed.

Neither party will be liable for a failure or delay in performance caused by events beyond its reasonable control, including natural disasters, severe weather, fire, flood, power or network failure, labor disputes, acts of government, public-health emergencies, or the failure of a third-party service provider.

19. Account suspension and termination

You may stop using the Collective at any time and may request account deletion as described in the Privacy Policy.

We may restrict, suspend, or terminate your account or access if we reasonably believe:

you violated these Terms, the Community Guidelines, or applicable law;
your activity creates a safety, privacy, legal, or security risk;
guardian approval is missing, withdrawn, or cannot be verified;
you misrepresented your age, identity, qualifications, guardianship, or legal authority;
action is necessary to protect a minor or another member; or
continued access could harm the Collective or DirtDaisy.

When appropriate, we may provide notice or an opportunity to respond. We may act immediately when a concern is urgent or serious.

Provisions that by their nature should survive termination --- including ownership, content permissions already exercised, disclaimers, liability limits, indemnification, dispute terms, and legal record retention --- will survive.

20. Disclaimers

To the fullest extent permitted by law:

the Collective is provided "as is" and "as available";
DirtDaisy disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement;
DirtDaisy does not guarantee the identity, conduct, qualifications, reliability, or safety of any member, Ride Host, or other person at a ride;
DirtDaisy does not guarantee any ride, trail, route, condition, listing, map, forecast, skill label, capacity count, or third-party information; and
DirtDaisy does not guarantee that the Collective will be uninterrupted, secure, accurate, or error-free.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you. Nothing in these Terms limits any warranty or consumer right that cannot lawfully be excluded.

The risks of participating in mountain biking and the release of certain claims are addressed more specifically in the separate Mountain Biking Assumption of Risk & Liability Waiver.

21. Limitation of liability

To the fullest extent permitted by law, DirtDaisy LLC and its owners, officers, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, goodwill, opportunity, or profits, arising from or related to the Collective.

To the fullest extent permitted by law, DirtDaisy's total liability for claims arising from or related to the Collective will not exceed the greater of:

the amount you paid DirtDaisy for the specific Collective service giving rise to the claim during the twelve months before the event; or
one hundred U.S. dollars (US $100).

These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not apply to liability that cannot lawfully be limited or excluded. Nothing in these Terms releases or limits liability for conduct constituting greater-than-ordinary negligence, reckless conduct, intentional misconduct, or any other liability that cannot be waived under applicable law.

The separate Mountain Biking Assumption of Risk & Liability Waiver contains additional provisions specifically governing activity-related risks and claims.

22. Indemnification

To the fullest extent permitted by law, an adult member agrees to defend, indemnify, and hold harmless DirtDaisy LLC and its owners, officers, employees, contractors, and representatives from third-party claims, liabilities, damages, judgments, losses, and reasonable legal expenses arising from:

the member's unlawful conduct;
the member's material violation of these Terms;
Member Content that infringes or violates another person's rights; or
the member's intentional misconduct or misuse of the Collective; or
the acts or omissions of any person the member brings to a ride, including a minor in the member's care.

A parent or legal guardian accepting these Terms on behalf of a teen member, or bringing a minor to a ride, agrees to this provision with respect to their own acts and omissions, including a material misrepresentation of guardianship authority. This section does not require a minor to indemnify DirtDaisy and does not apply to the extent a claim was caused by conduct for which indemnification cannot lawfully be required.

23. Governing law and disputes

Except where applicable law requires otherwise, these Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles. Nothing in this section deprives you of the protection of any mandatory consumer-protection or other law of the state where you reside or where an activity occurs that cannot be varied by agreement.

Before filing a lawsuit, you and DirtDaisy agree to make a good-faith effort to resolve the dispute informally. Send a written description of the issue and requested resolution to crystal@dirtdaisy.com. DirtDaisy will use the email address associated with your account to contact you. Neither party may file suit until 30 days after that written notice is sent, unless the claim is one described below as exempt.

If the dispute is not resolved, and except where applicable law requires otherwise, any court proceeding arising from or relating to these Terms or the Collective must be brought in a state or federal court with jurisdiction in Hennepin County, Minnesota. You and DirtDaisy consent to personal jurisdiction and venue there.

This section does not prevent either party from:

seeking emergency or temporary injunctive relief;
reporting a safety issue or suspected crime;
making a complaint to a government agency; or
bringing an eligible claim in small-claims court.

These Terms do not require arbitration and do not waive a right to a jury trial.

24. Changes to these Terms

We may update these Terms as the Collective grows, our practices change, or legal requirements develop.

When we make material changes, we will provide reasonable notice through the Collective, by email, or by another appropriate method. We will update the version and effective date. If a change requires renewed consent, we will ask you --- and, where applicable, the approving parent or legal guardian --- to accept the updated Terms before continuing to use affected features.

Changes will apply prospectively from their effective date unless the law requires otherwise. The version accepted by a member or guardian will be recorded as part of our policy-acceptance records.

25. General terms

Entire agreement. These Terms, together with the Privacy Policy, Community Guidelines, the applicable Mountain Biking Assumption of Risk & Liability Waiver, and any additional terms presented for a specific feature or event, form the agreement between you and DirtDaisy regarding the Collective. The Community Media License applies only if you separately and voluntarily accept it.

If a specific, separately accepted term conflicts with these general Terms, the more specific term controls for that subject. The separate waiver controls for assumption of risk and release of activity-related claims.

Severability. If any provision is found unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

No waiver. If DirtDaisy does not enforce a provision immediately, that does not waive our right to enforce it later.

Assignment. You may not transfer your account or assign these Terms without our written permission. DirtDaisy may assign these Terms as part of a merger, reorganization, financing, sale of assets, or transfer of the Collective, subject to applicable law and the Privacy Policy.

Electronic communications. You agree that electronic acceptance and communications may satisfy legal requirements for a writing or signature to the extent permitted by law. Keep your email address current so we can provide account and policy notices.
