This one is completely optional
Sometimes we'd love to share a photo from a ride --- on our website, on social media, in an email, maybe someday on a hangtag or a poster. When that photo is yours, or you're in it, we want your permission first.
This document is how you give it.
You never have to accept this. You can be a full member of the DirtDaisy Collective, join every ride, post Ride Memories, host, and use every feature without ever accepting this license. Declining changes nothing about your membership. We won't ask twice, and nobody will know either way.
You can change your mind. See Section 6.

1. What this is and isn't
The Terms of Service already give DirtDaisy a limited technical license to host, store, and display what you post --- that's what makes the app work. It does not allow us to use your image or your content in advertising, merchandise, or promotion.
This document is what allows that. It's separate, it's voluntary, and accepting it is not a condition of anything.
This license is not part of the Terms of Service and does not change them. It is not a waiver, it does not affect your legal rights regarding riding risk, and it is not a modeling or employment agreement.
2. Who can accept it
You can accept this license if you are a DirtDaisy Collective member who is 18 or older.
Members under 18 cannot accept this license, and we don't offer a version for them. We do not use identifiable images of anyone under 18 in advertising, merchandise, or promotional campaigns.
3. What you're giving permission for
If you accept, you give DirtDaisy LLC a nonexclusive, worldwide, royalty-free license to use the following in connection with promoting the DirtDaisy Collective, DirtDaisy products, and women's mountain biking generally:
- Your name or username, as you've set it
- Your likeness --- your image, appearance, and voice as captured in photos or video from Collective rides or events
- Media you submitted --- photos, video, and captions you posted to the Collective
- Your written words posted publicly in the Collective --- a Ride Memory, a trail note, a comment --- as a quote
Where we might use it: our website, app, social media, email newsletters, printed materials, packaging and hangtags, event displays, press and media features, and paid advertising.
What we may do to it: crop, resize, reformat, color-correct, caption, subtitle, excerpt, and combine it with other content, so it works in different places. We may sublicense to the vendors who make and place these things for us --- a printer, a design agency, an ad platform.
We may keep using it after you stop being a member, subject to Section 6.
4. What you're not giving permission for
To be clear about the limits, we will not:
- Sell or license your image or content to another company for its own advertising or products
- Use your content in a way that suggests you endorse a third-party brand, product, political position, candidate, or cause
- Alter your image or words to change their meaning, or caption them in a way that misrepresents what happened or what you said
- Use content in a sexualized, degrading, or demeaning way
- Publish your precise location, home address, phone number, email, employer, or other private information alongside your image
- Use content you've asked us to remove, or content removed under the Photo & Content Removal Policy
- Use identifiable images of anyone under 18
You keep ownership of everything. This license doesn't transfer your copyright or any other right you hold, and it doesn't stop you from using your own photos however you want.
We are never obligated to use anything. Accepting this license is permission, not a promise that you'll be featured.
5. You can only give permission for yourself
This is the important limit.
You may only license your own likeness and your own content. You cannot give us permission for anyone else.
That means:
- Not other adults. If your photo has other riders in it, this license covers you, not them. We need their own permission before we could feature them identifiably.
- Not your children. Accepting this license applies to you alone. It gives us no permission regarding your child, of any age, and we don't offer a license that would. We do not use identifiable images of anyone under 18 promotionally.
- Not anyone whose photo you posted. Posting a photo doesn't make its subject yours to license.
You confirm that any content you're licensing is yours to license --- that you created it or hold the rights, and that it doesn't infringe anyone else's rights.
If we want to feature a photo with several people in it, we'll get permission from each identifiable adult, or we won't use it identifiably.
6. Changing your mind
You can withdraw this license at any time, for any reason or none, by emailing removal@dirtdaisy.com with the subject line Media License Withdrawal. You don't have to explain.
Here's what happens, honestly:
What we'll do. We stop using your image and content in anything new. We remove it from our website, app, and social media where we control the posting, and from any campaign still in progress, within a reasonable time. We tell our vendors to stop.
What we can't undo. Some things can't be recalled:
- printed material already produced --- hangtags, packaging, posters, catalogs
- physical merchandise already made or sold
- an advertisement already placed and running through a committed term
- content already published by a press outlet or reshared by someone else
- copies in archives, backups, or records
We'll stop producing anything new with it, and we won't reprint. But we can't pull back what's already in the world, and we'd rather tell you that now than surprise you later.
What withdrawal doesn't affect. Your membership, your account, your ability to join rides, and your standing in the community --- none of it changes. Withdrawing is not a strike against you and won't be treated as one. Your content stays in the Collective under the ordinary Terms of Service unless you delete it.
You can accept again later if you want.
7. No payment
This is unpaid. You're not entitled to compensation, royalties, credit, or approval over how something is used, and accepting doesn't make you an employee, contractor, model, ambassador, or partner of DirtDaisy.
If we ever want to work with you in a paid capacity, that's a separate conversation and a separate agreement.
8. What we record
When you accept or withdraw this license, we record your name, account, the policy key, the version, and the date, time, and context of your action.
That record is private. It isn't shown on your profile, isn't visible to other members or Ride Hosts, and doesn't appear in the Member Directory. The Privacy Policy explains how we handle and retain it.
We keep the record of an acceptance after a withdrawal, so we can show what was permitted and when.
9. General terms
Version changes. If we materially expand what this license permits, we'll ask you to accept the new version. We won't apply an expanded version to content licensed under an earlier one without asking. Minor clarifications will be posted with a new version number and effective date.
Governing law. Except where applicable law requires otherwise, this license is governed by the laws of the State of Minnesota, without regard to conflict-of-law principles, and any court proceeding arising from it must be brought in a state or federal court with jurisdiction in Hennepin County, Minnesota.
No arbitration. This license does not require arbitration and does not waive your right to a jury trial.
Severability. If any part is unenforceable, the rest stays in effect.
Whole agreement. This license, together with the Terms of Service and Privacy Policy, covers promotional use of your likeness and content. It doesn't replace the Photo & Content Removal Policy, which you can use whether or not you've accepted this.
